Terms & Conditions

Your use of the EmployTask service indicates that you accept these Terms of Service (the "Agreement"). If you do not accept these terms and conditions, do not launch the service.

This Terms of Service represent the agreement ("Agreement") is an agreement between you (the "User") and EmployTask, LLC. We provide Users with access to our system, which can track and manage their vehicles by providing general and personalized information, communication tools, mobile applications, map tools, and services (collectively referred to as "the Service," the "Subscription") directly, which information shall be used by you for your purposes and which use is outside the control of Employtask. If you have suggestions that can help us improve it or any questions about this Agreement, please email us and let us know. This Agreement explains our obligations to you, and your obligations to us.

General Terms of Service

  • Do not use the Service for any illegal, unauthorized, unintended, unsafe, or unlawful purposes. It is your responsibility to ensure that your intended use of GPS tracking does not violate local, state, or federal laws.

  • You may not use our service to track a person without his or her consent or track an object without the permission of its owner.

  • When you pay for GPS hardware equipment it becomes your property. Purchasing equipment is a one-time purchase, Subscription on the other hand is a recurring cost to receive services.

Free Trial Service

EmployTask Tracking System is available to everyone that registers during the free trial, free of charge. After the end of the 14-day trial period, our services will completely or partly be liable to a monthly subscription fee. A detailed description of these service plans shall be available on our website on the pricing page or sent to all of our customers, who can then decide whether to further employ our services. 

14-Day Trial Is Over    

The 14-day upgraded trial is available once for each administrator account. After the 14 days trial is up, you need to choose a subscription and paid, otherwise EmployTask will switch back your account to an Inactive state which means the mobile apps and your administrator account will stop working until you choose to subscribe for a monthly subscription.

Subscriptions Service

The Service includes automatically recurring payments for periodic charges (“Subscription Service”). If you activate a Subscription Service, you authorize Service Employtask to periodically charge, on a going-forward basis, and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. The “Subscription Billing Date” is the date when you purchase your first subscription to the Service. Your account will be charged automatically on the Subscription Billing Date for all applicable fees and taxes for the next subscription period. The subscription will continue unless and until you cancel your subscription or we terminate it. You must cancel your subscription before it renews to avoid charging the next periodic Subscription Fee to your account. You may cancel the Subscription Service by contacting us throw the support portal.

Payment

You agree to pay all fees charged to your account for the EmployTask service. If you choose any subscription, you will be charged such fees each month, even if you do not use the EmployTask service. This subscription can be any time canceled from your side. We reserve the right to change the fees for the EmployTask service at any time, upon prior notice to you.

Delinquent Accounts

 

EmployTask may suspend or terminate access to the Service, including fee-based portions of the Service, for any account for which any amount is due but unpaid. In addition to the amount due for the Service, a delinquent account will be charged with fees, charges, or expenses (including attorneys’ fees) that are incidental to any chargeback or collection of any unpaid amount, including collection fees.

Refund Policy

No refunds with EmployTask or any of the apps from the EmployTask. You may cancel your EmployTask account by opening a ticket on the support portal. Your account will be suspended at the ending of the current (when the account was requested for cancellation) month. For example, if you request an account cancellation on the 15th of a month, you will not be charged after the last date of the month. No immediate cancellations will be entertained.
 

Account Registration

Our Service requires you to register. If you register, you agree to provide us with accurate, complete registration information. Your registration must be done using your real name and accurate information.
 
Each registration is for your personal and business use only and not on behalf of any other person or entity. We do not permit (a) any other person using the registered sections under your name or username; or (b) access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorized use. You are responsible for maintaining the security of your account and password. You are also responsible for all Content posted and activity that occurs under your account.

Mobile Applications

  • Geo-Location Information - We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

  • ​Mobile Device Access - We may request access or permission to certain features from your mobile device, including your mobile device’s [bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage,] and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

  • Mobile Device Data - Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

  • Push Notifications - We may request to send you to push notifications regarding your account or the Application. If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings.​

Cell Phone Provider Charges

You are responsible for any fees assessed by your wireless telephone carrier to access the EmployTask service and mobile applications including SMS and any data plan charges, toll, out-of-area, roaming, SMS, or other telephone connection charges. Standard messaging rates and other charges may apply when using certain features in the EmployTask service.

 

Service Coverages And Quality     

 

EmployTask service works nationwide. However, EmployTask relies on your mobile service provider the services of GPS Satellites and local GSM network operators to deliver its services that are not under EmployTask service. EmployTask service, therefore, cannot be held responsible if there is poor or no GPS or GSM reception coverage. EmployTask service does not guarantee service functionality or security, and storage of received information. You use EmployTask service at your own risk. The service is provided "As Is".

 

Alert Disclaimer 


You understand and agree that any Emails or SMS text alerts provided to you through the use of our platform, products, tracking platform, and services may be delayed or prevented by a variety of factors. EmployTask does its best to provide alerts promptly with accurate information. However, we neither guarantee the delivery nor the accuracy of the content of any alert. You also agree that EmployTask shall not be liable for any delays, failure to deliver, or misdirected delivery of any alert; for any errors in the content of an alert; or any actions taken or not taken by you or any third party in reliance on an alert.

 

Features

EmployTask reserves the right to remove, modify, and/or add Features at any time, without any notice or obligation to Customer, and for any reason whatsoever. Some Features may, in any event, be limited, suspended, or restricted by geography, volume, duration, or any other criteria decided by EmployTask in its sole discretion or required by the applicable third-party provider. Moreover, if EmployTask determines that Customer is in breach of any provision of this Agreement, EmployTask reserves the right to block or suspend Customer from certain Features. EmployTask may in its sole discretion charge for Features as part of the Fees and/or require additional personal information. The customer acknowledges and agrees that just because EmployTask makes a Feature available, it does not mean EmployTask endorses, or can otherwise control, every manner in which such Feature is used. Each Feature may be accompanied by separate or additional terms and conditions, as well as additional fees (in each case, “Feature Specific Terms“). Unless stated otherwise in Feature Specific Terms, all Feature Specific Terms apply in addition to (and not instead of) this Agreement.

 

Updates & Support

Updates. All references herein to the “Service” shall include the Updates provided by or on behalf of EmployTask under this Agreement. EmployTask may from time to time provide Updates, but shall not be under any obligation to do so. Such Updates will be supplied according to whatever then-current internal policies EmployTask may have in place, and some Updates may, in any event, be limited, suspended, or restricted by geography, volume, duration, or any other criteria decided by EmployTask in its sole discretion. Some Updates may include automatic updating or upgrading without any notice or obligation to the Customer, and the Customer consents to any such automatic updating or upgrading of the Service. In some cases, the Customer may be required to install the update manually. An Update may be accompanied by separate or additional terms and conditions, as well as additional fees (in each case, “Update Specific Terms“). Unless stated otherwise in Update Specific Terms, all Update Specific Terms apply in addition to (and not instead of) this Agreement.

 

Feedback

 

If you provide feedback to us regarding the Service or EmployTask website to the platform (“ Feedback”), you authorize us to use that Feedback without restriction and payment to you. Accordingly, you hereby grant to us a non-exclusive, fully-paid, royalty-free, perpetual, and irrevocable license to exploit the Feedback in any manner and for any purpose.

 

Google Maps

Google Maps presented to you through the Service are powered by Google. Your use of Google Maps is subject to the Google Maps Terms of Service, available online at https://www.google.com/intl/en-US_US/help/terms_maps, and https://www.google.com/intl/ALL/policies/privacy/index.html, and by using the Service, you are agreeing to be bound by such terms.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your service, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

Disclaimer of Warranties

THE SERVICE AND ALL RELATED INFORMATION ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESSED OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT FOR A PARTICULAR PURPOSE. THE SERVICE MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. EMPLOYTASK IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS.

The Services may be temporarily unavailable for scheduled maintenance or unscheduled emergency maintenance, or because of other causes beyond our reasonable control, but EmployTask shall use reasonable efforts to provide advance notice of any material scheduled service disruption. Each User is solely responsible for determining the appropriateness of using the Service and assumes all risks associated with its exercise of rights under this Agreement, including but not limited to the risks and costs of program errors, compliance with applicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption of operations.

 

Limitation of Liability

NEITHER EMPLOYTASK NOR ANY CONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST SALES OR BUSINESS, LOST DATA), HOWEVER, CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SERVICE OR THE EXERCISE OF ANY RIGHTS GRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Indemnification

You agree to indemnify, defend and hold EmployTask, its suppliers, and its licensors (including their respective licensors, suppliers, assignees, subsidiaries, affiliated companies, and the respective officers, directors, employees, shareholders, agents, and representatives of each of them) free and harmless from and against any liability, demand, cost, expense, or claim of any kind or character, including but not limited to attorney's fees, arising out of or in connection with your use of the Service or the EmployTask.

Monitoring Disclaimer

We are not a monitoring company. As a customer and user of our Service, you have the ability and responsibility to monitor your fleet, assets, and employees and we give you the ability to effectively do that. EmployTask may, but has no obligation to monitor activity on the site or events created using our services and equipment. We closely monitor the operations of the tracking platform, mobile apps, and GPS devices data only in the sense that we ensure accurate and reliable transmission to and from our equipment and services.
